Link-up Version 2 (V.2) Coding Structure: The Link-up coding structure has evolved as part of the move to version two (V.2) of the industry recognised supplier management scheme. The previously used "Product Groups" have been replaced by a hierarchy of codes driven by a combination of industry assets, products and services with associated lifecycle activities. There are 19 level 1 codes supported by a series of level 2 codes. SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION III.1) CONDITIONS FOR PARTICIPATION III.1.1) Qualification for the system Conditions to be fulfilled by economic operators in view of their qualification: This notice announces the existence of the qualification/registration scheme operated by Achilles Information Ltd (Link¬up) on behalf of the contracting entities listed in VI.3), hereinafter referred to as 'subscribers'. It incorporates any changes that have occurred since the last notice and supersedes it. Link-up has been established as an industry-based service to assist the UK rail companies, their associated transport activities and other transport-related organisations including the airport, bus and port sectors, by providing efficiencies through the administration of a single qualification scheme and database. For all of the product and service categories listed, Link-up will provide a register of suppliers and contractors to the subscribers listed in VI.3), and for some of the categories a second stage qualification will be applied as part of the scheme. Registered and qualified suppliers may be considered by subscribers for contract opportunities, without further notification of requirements in the “Supplement to the Official Journal of the European Union”, Each subscriber may impose further qualification stages and in addition certain contract opportunities may be published separately, even though they relate to the product and service categories listed in II.1.2). Each subscriber may also, at its own discretion, use the system as the basis for selection of tender lists below EC thresholds. Each subscriber may use the database for contracts not subject to EC rules. There is an annual fee for registration on the Link-up database and this is identified on the registration form sent to suppliers prior to joining the scheme. Those Suppliers wishing to register on the Link-up database should reply to the address in I.1). Applicants will be sent a registration form, which should be returned, accompanied by the registration fee, levied as a contribution towards the annual administration costs of the system. On receipt of the registration form and fee, access to an on-line questionnaire will be made available to applicants. Applying companies should be aware that once the questionnaire is fully completed there is a period of time necessary for processing applications prior to making company details available to Buyers. A visit to the applicant's premises may be necessary to confirm responses made in the questionnaire; such visits may be charged to the applicant. Applications to supply safety critical products and/or services will be subject to an audit before qualification will be awarded - all applicants will receive full details on application. Suppliers or contractors that have already applied to the Link-up scheme must ensure they have completed the information required in the new version of the questionnaire ("Version 2") in order to be available for selection by transport organisations that use Link-up to for information needed to award contracts. Failure to complete the new questionnaire may affect a Suppliers ability to work on rail infrastructure and will affect Supplier's business prospects with subscribers who use the scheme. VI.3) PROCEDURES FOR APPEAL VI.3.2) Lodging of appeals: Precise information on deadline(s) for lodging appeals: Subscribers subject to the EC procurement legislation will where appropriate incorporate a minimum ten calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the subscribers before the contract is entered into. Applicants have two working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum of three working days before expiry of the standstill period. If an appeal regarding the award of a contract has not been successfully resolved the Utilities Contracts Regulations (SI 2006 No 6) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). There are similar provisions in The Utilities Contracts (Scotland) Regulations 2006 but the forum for legal action is the Sheriff Court, the Court of Session or in England and Wales and Northern Ireland, the High Court. Any such action must be brought promptly (Generally within three months). Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages.
