SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): UKAEA's
internal Information and Communications Technology (ICT) service provider,
known as ISaT, provides services to 5 organisations within the UKAEA Group
and to the Civil Nuclear Police Authority. UKAEA intends to procure these
services from an external contractor who will contract separately with
each of the 6 customer organisations, as well as taking on other ad hoc
ISaT contracts. The six main contracts have variable durations of up to 60
months. The ISaT staff will transfer to the contractor in accordance with
the Transfer of Undertakings Protection of Employment (TUPE) Regulations.
The contractor will be required to provide a pension scheme for the staff
with benefits equivalent to their current scheme, including being based on
final salary.
ISaT services approximately 2 600 desktop users and has an annual turnover
of approximately 8 000 000 GBP, including the cost of project work,
managed telecoms and consumables. It provides an end-to-end ICT service,
covering all activities from procurement and deployment of equipment,
support services, server hosting and management, application management
and delivery, service desk, service management and telecoms services.

Annul UKAEA reserve the right to annul the tendering process and not award
a contract.
Sub-contract UKAEA work within strict safety guidelines and you will be
required to specify and justify any proposals to subcontract.
Security tenderers should note that aspects of this procurement will be
subject to United Kingdom security requirements. The procurement is
therefore exempt from the EU Procurement Directives and UKAEA is not
legally obliged to follow the process set out in them. UKAEA reserves the
right voluntarily to conduct the procurement process along the lines of
the procedures of the Directives and subject to any divergences from those
procedures that appear to UKAEA to be appropriate in all circumstances.

VI.4) PROCEDURES FOR APPEAL

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: UKAEA will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before a contract
is entered into. Applicants have 2 working days from the notification of
the award decision to request additional debriefing and that information
has to be provided a minimum of 3 working days before the expiry of the
standstill period. Such additional information should be sought from the
contact named in this notice.
If an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 no 5, which apply to
England, Wales and Northern Ireland, and the Public Contracts (Scotland)
Regulations 2006 no 1, which apply to Scotland, provide for aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the sheriff court, the Court of Session,
(Scotland) or in England and Wales and Northern Ireland, the High Court.
Any such action must be brought promptly (generally within 3 months) Where
a contract has not been entered into the Court may order the setting aside
of the award decision or order the authority to amend any document and may
award damages. If the contract has been entered into the Court may only
award damages.
